Child custody: Decision factors

Going through divorce is one of the most difficult things you will ever do. This is why so many people try their best to avoid this, even if it means putting a lot of time into making the relationship work. If you’ve tried everything and divorce is the only answer, it’s time to think about how this will change the future.

Do you have children? If so, you need to take this into consideration, as child custody matters will soon move to the forefront.

In short, the court is going to consider numerous factors when making custody related decisions. Above all else, they want what is best for the child. They will do whatever it takes to make sure the child is put in the best position possible.

Some of the factors that are taken into consideration include:

  • The wishes of the child, if he or she is old enough to communicate a preference.
  • The health of the parents.
  • The relationship with each parent.
  • The home environment provided by each parent.
  • The sex and age of the child.
  • Whether or not either parent has a history of alcohol, drug or sexual abuse.

No one wants to deal with matters of child custody, but this is something that you could be faced with if you are going through a divorce. The best thing you can do is make decisions that are best for your child/children. After all, this is the approach the court will take.

Since there is a lot that goes into determining child guardianship, make sure you understand your legal rights from the start.
